Our Services may include the use of AI and other automated systems to assist in generating text, imagery, or other creative outputs based on your submissions.

3. User Accounts

You may need to create an account to use certain features.

We reserve the right to suspend or terminate accounts that violate these Terms or are used for fraudulent, abusive, or illegal activity.

4. User Content

"User Content" includes any data, photos, text, or other material you upload or submit to For You Tales to create your personalized story or artwork.

You retain ownership of your User Content but grant For You Tales a limited, non-exclusive, royalty-free, worldwide license to use, reproduce, adapt, modify, and display your content solely to provide and improve the Services, including AI processing and fulfillment (e.g., printing and shipping your book).

We will never publicly display or sell your User Content without your explicit consent.

You may request deletion of your User Content at any time using our Data Deletion Request Policy.

You represent and warrant that:

• You own or have permission to use and upload all User Content;
• Your submissions do not infringe on any third-party rights or violate any laws; and
• Any photos or information about minors are provided with parental or guardian consent.

5. Generated Content and Intellectual Property

a. Ownership of AI-Generated Material

All AI-generated stories, images, or related materials ("Generated Content") are created using proprietary systems and third-party technologies.

• You own the personal copy of your Generated Content (e.g., your personalized storybook).
• For You Tales retains all underlying rights to its software, templates, prompts, and artistic processes.
• You may use your Generated Content for personal, non-commercial purposes (such as sharing, printing, or gifting).
• Commercial resale, redistribution, or reproduction of Generated Content requires prior written consent from For You Tales.

b. Ownership of Site Materials

All text, graphics, code, images, and other materials on the Site (other than your User Content) are the property of For You Tales, LLC and protected by copyright, trademark, and other intellectual property laws. You may not copy, modify, distribute, or create derivative works from any portion of the Site or Services without our written permission.

6. Payments and Orders

a. Pricing

Prices for our custom books and digital products are listed on our Site. All amounts are in U.S. dollars unless otherwise stated.

b. Payment Processing

Payments are processed securely through third-party providers (e.g., Stripe, Shopify Payments). By completing a purchase, you authorize us to charge your selected payment method for the total amount due.

c. Refunds and Replacements

Because our products are custom-made, orders are generally non-refundable once production begins. However, we will replace or correct items that arrive damaged, defective, or incorrect. To request support, email support@foryoutales.com within 14 days of delivery.

d. Deliveries

Although our dream is to ship globally, our shipping is currently limited to the United States (but not all areas). We deliver to most U.S. locations; however, certain addresses may be outside our delivery range. If we are unable to ship to your address, we will notify you and issue a full refund.

While we aim to process and deliver your order promptly, all production and delivery times provided are estimates only and are not guaranteed. Delivery timeframes may vary based on order volume, customization complexity, carrier delays, weather conditions, or other circumstances beyond our control. We are not responsible for delays, missed delivery dates, or indirect losses arising from late shipment or carrier issues. Ownership and risk of loss transfer to you once the order is accepted by the carrier.

If your order does not arrive within a reasonable time, please contact support@foryoutales.com, and we will assist with tracking, replacement, or other appropriate remedies.

7. Privacy and Data Protection

Your use of our Services is subject to our Privacy Policy, which explains how we collect, use, and safeguard your information — including uploaded photos and data about children. By using our Services, you consent to our processing of personal information as described in the Privacy Policy.

8. Prohibited Uses

You agree not to use the Site or Services to:

• Upload or share unlawful, obscene, or infringing content;
• Impersonate any person or entity;
• Attempt to reverse engineer, scrape, or hack the Site;
• Interfere with others' use of the Services;
• Upload AI-generated content not created through For You Tales for resale;
• Submit content that promotes hate, abuse, or discrimination.

We reserve the right to remove any User Content or terminate accounts that violate these Terms.

9. Disclaimer of Warranties

Although we do our best to put smiles on faces, our Services are provided "as is" and "as available" without warranties of any kind, express or implied.

We do not guarantee that:

• The Site will be uninterrupted or error-free;
• Generated Content will meet your expectations or be completely accurate;
• Uploaded data will never be lost (though we take security seriously).

To the fullest extent permitted by law, we disclaim all warranties, including merchantability, fitness for a particular purpose, and non-infringement.

10. Limitation of Liability

To the maximum extent permitted by law:

• For You Tales, LLC and its affiliates shall not be liable for any indirect, incidental, consequential, or punitive damages arising from your use of the Site or Services.
• Our total liability for any claim shall not exceed the total amount you paid for the product giving rise to the claim.

Some jurisdictions do not allow limitations on implied warranties or certain damages, so portions of this section may not apply to you.

You agree to defend, indemnify, and hold harmless For You Tales, LLC, its officers, employees, affiliates, and partners from and against any claims, damages, or expenses (including legal fees) arising out of:

These Terms are governed by the laws of the state of Florida (USA) without regard to conflict of law principles. Any dispute arising out of or related to these Terms shall be resolved through binding arbitration in Tampa, Florida, under the rules of the American Arbitration Association (AAA). Each party waives the right to a jury trial or class action.
